By accessing and using this site and Meteomed's services in all their forms (such as, but not limited to, progressive web apps, M-sites, telephone services, email and SMS) implies that you have read, acknowledged and accepted these terms and conditions.

Access and use of this site, including web pages, progressive web apps and telephone services, and any communication with Meteosolutions S.r.l, consultation of sea condition and weather forecasts and purchase of premium content subscriptions, is for the exclusive purpose of leisure boating and recreational sports and not intended for commercial or business activities, unless you are a commercial user and as such you have been declared and identified by Meteosolutions S.r.l.

Please be aware that you are solely responsible for the use of Meteomed and its contents. Meteosolutions S.r.l cannot be held responsible for any use of the website and its content by any of its users which is not in compliance with applicable laws, except in the case of Meteosolutions S.r.l's liability for wilful misconduct and gross negligence. In particular, you will be solely liable for the communication of incorrect or false information and data relating to third parties, without their express consent, as well as regards the improper use of it.

Meteosolutions S.r.l. does not hold any liability for damage to computer systems or loss of data resulting from consultation and download operations. Liability lies with the user. Meteosolutions S.r.l. does not accept any liability for any damage caused by viruses, corrupted files, errors, omissions, service interruptions, deletion of content, network-related problems, problems related to providers or to telephone and/or electronic connections, unauthorised access, data alteration, and the failure and/or defective operation of the user's electronic equipment. You agree not to modify, alter, translate, adapt, decompile, decode or disassemble any information or other material that you may access through Meteomed and you undertake to indemnify Meteosolutions S.r.l. for any expenses, costs, damages and losses that you may sustain, directly or indirectly, following the violation of these principles.

You are responsible for the safekeeping and proper use of your personal information, including credentials that allow access to restricted services, as well as for any damages or detriment which might arise against Meteosolutions S.r.l. or third parties as a result of incorrect use, loss, and/or removal of such information.

Meteosolutions S.r.l. makes every reasonable effort to ensure the accuracy of weather information, but uncertainty in weather forecasting is inevitable and you acknowledge that you are fully aware of this.

The information is provided "as is" and on an "as available" basis, without any express or implied guarantee, including accuracy, completeness, correctness, timeliness, or fitness for a specific purpose. You agree to evaluate and endure all the risks associated with the use of any information, including relying on the accuracy, completeness, correctness, timeliness, or usefulness of such information.

You are aware that Meteorotte cannot be used for navigation. In all Meteomed cartographic representations, the coastline is an approximation and there is no concept of depth. Therefore, the route may cross shallow areas, land or rocks, and it is your responsibility to change the route to avoid these dangers for navigation. You agree to accept all liability for the risks associated with navigation.

The information provided by Meteomed is provided in good faith and Meteosolutions S.r.l. considers it to be accurate. Meteosolutions S.r.l. has taken every useful precaution to ensure that its information is correct and up-to-date. However, Meteosolutions S.r.l. assumes no responsibility for the accuracy and completeness of the published content, other than its own liability for misconduct and gross negligence and as otherwise required by law.

Meteosolutions S.r.l. and its suppliers and distributors do not assume any responsibility or legal liability for any loss, damage or injury (including death) that may result, either directly or indirectly, from the use of marine weather forecasts and Meteomed's services.

Continuity of supply and service
Although Meteosolutions S.r.l. does everything in its power to ensure that access to its content and services is uninterrupted, the dynamic nature of the Internet and phone/mobile data connections may not allow it to operate without suspensions, interruptions or discontinuities due to the need to make updates and maintenance to its platform and technology infrastructure.

Meteosolutions S.r.l. has taken appropriate technical and organisational measures to safeguard the security of its services and the integrity of traffic data and electronic communications regarding forms of use or knowledge that are not allowed and to avoid the risks of leakage, destruction and loss of data and confidential information.

The Meteomed personal account

To use some of our services you may need to open a personal Meteomed account. The Meteomed account can be created by the user personally, or be assigned by a Meteomed administrator, supplier, or distributor. If an account is used that has been assigned by a distributor, different or additional terms may apply, and the administrator may also be able to access and disable the account.

You are aware that the information you provide at the time of registration must be accurate, up-to-date and complete, and you commit to making sure that this information remains accurate, up-to-date and complete at any time, promptly making any necessary changes.

If you provide false, inaccurate, incomplete or misleading information, or Meteosolutions s.r.l. has reasonable grounds to suspect that such information is false, inaccurate, incomplete or misleading, you agree that Meteosolutions S.r.l. may suspend or close your account and refuse to provide any current or future use of your content and services.

The account is personal and can only be used by the user who created it. You will need to ensure the confidentiality of your passwords and you will not be able to authorise third parties to access or use the services for your account.

If Meteosolutions s.r.l. has reasonable grounds to suspect that the account is also used by third parties, you agree that Meteosolutions S.r.l. may suspend or close the account and refuse to provide any current or future use of its contents and services.

If you become aware or suspect that the account is being used by unauthorised third parties or that the security of the service has been violated, please contact Meteosolutions S.r.l. immediately by writing to info@meteomed.it or if you have a subscription, to abbonamenti@meteomed.it

Subscriptions to content and Premium services

Meteosolutions S.r.l. has adopted its own trading policy and the user can purchase subscriptions to Premium Meteomed content online on the site, by telephone by calling the Meteosolutions mainline number, or through distributors authorised by Meteosolutions S.r.l.

All Meteomed subscriptions are personal, sold to the "final consumer". This term means an individual or legal entity acting via our website, app, email, telephone and SMS for purposes other than carrying out their own trade, business or professional activity.

The assignment to a third party of personal subscription is not permitted on any occasion or for any purpose. The illicit transfer to third parties of your subscription, or rather of personal data to access your personal account and consult Premium Services, will void your subscription.

Subscription business not specifically authorised by Meteosolutions S.r.l. is prohibited.

Meteosolutions S.r.l. has the right not to consider purchase orders from non-authorised distributors or final consumers and any other purchase order that does not comply with the General Conditions of Sale and these General Conditions of Use.

Intellectual Property Rights
Meteomed content, such as, but not limited to, logos, images, figures, drawings, photographs, texts, music, sound and videos, documents, and any other material in any format published by Meteosolutions s.r.l., including menus, web pages, graphics, colours, schemes, tools, fonts and website design, layouts, methods, processes, functions, and software that are part of Meteomed are protected by copyright and any other intellectual property right of Meteosolutions S.r.l. and other rights holders. Full or partial reproduction of this website and its contents in any form is prohibited without prior written consent from Meteosolutions S.r.l.

Users are only authorised to access and view its contents for private use. The user is also authorised to perform all other temporary acts of reproduction, devoid of economic significance, which are considered transient or incidental, integral and essential part of viewing itself of its content and all other navigation operations that are carried out only for a legitimate use of the website.

Trademarks and domain names
Meteosolutions S.r.l. is the exclusive owner of the logos and "Meteomed" trademark and any other distinctive sign that includes the word "meteomed", including the domain name "www.meteomed.it, domain name list and progressive web app Meteomed" and has the right to make exclusive use of trademarks and domains of their own.

There may be links to other Internet sites that are beyond the control of Meteosolutions S.r.l.; the publication of such links or advertisements does not imply approval or endorsement of Meteosolutions S.r.l. of its sites and their contents. Neither does it imply any form of guarantee by Meteosolutions S.r.l. The user hereby acknowledges that Meteosolutions S.r.l. is not responsible for the veracity, correctness, completeness, respect for intellectual property rights and/or industrial property rights, legality and/or any other aspect of such sites. Neither is it accountable for their possible opposition to public order, good manners and/or to morals. Meteosolutions S.r.l. therefore does not take any responsibility for links to sites, advertisements and third-party content present or accessible via Meteomed.

Information and materials sent to Meteosolutions S.r.l.
Any material or information sent to Meteosolutions s.r.l., for example via email or via web or progressive web app, telephone or fax will be considered of a non-confidential nature. Meteosolutions s.r.l. accepts no liability for such material and may reproduce, use, disclose, display and transform it, make derivative works based on it and distribute it to third parties at will, without restriction. In addition, Meteosolutions S.r.l. will be free to use any ideas, concepts, know-how or technical knowledge contained in such material for any purpose, including, without limitation, the development, production and marketing of products using such material. Anyone submitting material guarantees that it is public and agrees to hold Meteosolutions s.r.l. harmless from any action by a third party in connection with such material.

Law and jurisdiction
These conditions are governed by Italian law. For any disputes arising from these terms and conditions, the Court of Bergamo, Italy, will have exclusive jurisdiction and competence. Nonetheless, Meteosolutions S.r.l. reserves the right, if it deems it necessary, to seek legal proceedings before the courts of countries or cities other than Italy or Milan to protect their interests and to enforce their rights.

Edit and update
Meteosolutions S.r.l. may amend or update, in whole or in part, these General Terms and Conditions of Use. Changes and updates to the General Terms and Conditions of Use will be binding as soon as they are posted on the web site in this section. Therefore, please access this section regularly to check the publication of the most recent and updated General Terms and Conditions of Use of Meteomed.it, .mobi, progressive web app, email, phone and SMS. If you do not agree, in whole or in part, with these General Terms and Conditions of Use, please do not use our web site, progressive web app, email, phone or SMS service.

If you disagree with these terms and conditions, you must immediately stop using navigation, browsing and use of Meteomed content and services.
